I support the broadcast flag requirement, but this decision gets it right, it seems to me. I always thought legislation was the appropriate place for a requirement such as this. And I'm extremely sensitive about appointed regulators having the power to impose burdens, taxes and tax-equivalents on the economy.
Policy should be implemented the elected representatives of the people as much as possible, not by appointed bureaucrats.
Process is as important as outcome. That's also why it's important that the judicial system includes excellent defense attorneys. It's not just important that the guilty be convicted. Process is critical.
